1. Acceptance of Terms
These Terms of Service ("Terms," "Agreement") constitute a legally binding contract between you ("User," "Customer," "you," or "your") and Dewey's Pizza ("Company," "we," "us," or "our"), the owner and operator of the website located at deweysdelivery.rest (the "Site") and all associated food delivery and ordering services.
By visiting the Site, creating an account, placing an order, or otherwise using any portion of our services, you expressly agree to these Terms in their entirety. Your continued use of the Site or services following any posted modifications to these Terms constitutes your acceptance of those changes. If you are using our services on behalf of a business, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, in which case "you" and "your" will refer to that entity.
These Terms apply to all users of the Site, including without limitation users who are browsers, customers, vendors, merchants, and/or contributors of content. Users must be at least 18 years of age to create an account or place an order. If you are under 18, you may only use our services with the involvement and consent of a parent or legal guardian.
Our services are intended for use by individuals located within the United States. By using the Site, you represent and warrant that you are accessing our services from within the United States and that your use complies with all applicable federal, state, and local laws and regulations.
2. Description of Services
Dewey's Pizza operates as a food service business offering pizza and related food and beverage products for dine-in, carry-out, and delivery. Through the Site, we provide users with the ability to:
- Browse our current menu offerings, including pizzas, appetizers, beverages, desserts, and other food items;
- Place orders for delivery or pickup at your selected location;
- Create and manage a personal customer account to track orders, save preferences, and manage payment methods;
- Receive promotional communications, special offers, and loyalty program benefits (where applicable);
- Communicate with our customer service team regarding orders, complaints, or general inquiries;
- Review estimated delivery times, track order status, and receive order confirmation notifications.
All food products offered through our Site are subject to availability. We reserve the right to modify, suspend, or discontinue any menu item, promotion, or service feature at any time without prior notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.
Delivery services are available within specific geographic zones. Availability of delivery to your address is subject to our current service area, which may change from time to time. We make no guarantee that delivery service will be available to every location within any given area.
All food products are prepared in facilities that handle common allergens, including but not limited to gluten, dairy, nuts, eggs, soy, and shellfish. It is the customer's sole responsibility to inform us of any dietary restrictions, allergies, or medical conditions prior to placing an order. We cannot guarantee allergen-free preparation environments, and we strongly encourage customers with severe food allergies to contact us directly before ordering.
3. User Accounts and Registration
To access certain features of our Site, including order history, saved payment information, and loyalty rewards, you may be required to register for a user account. When creating an account, you agree to:
- Provide accurate, current, and complete information during the registration process;
- Maintain and promptly update your account information to keep it accurate, current, and complete;
- Maintain the security and confidentiality of your login credentials, including your password;
- Accept responsibility for all activities that occur under your account;

4. User Obligations and Prohibited Activities
By using our Site and services, you agree to use them only for lawful purposes and in a manner consistent with all applicable federal, state, and local laws and regulations. You agree to comply with the following obligations and restrictions:
4.1 General Obligations
- Provide truthful and accurate information when placing orders, creating accounts, or communicating with us;
- Pay all applicable charges, fees, taxes, and delivery costs associated with your orders in a timely manner;
- Be present or designate an authorized recipient at the delivery address at the time of scheduled delivery;
- Treat our employees, contractors, and delivery personnel with respect and courtesy.
4.2 Prohibited Activities
You expressly agree that you will NOT engage in any of the following activities:
- Use the Site or services for any unlawful, fraudulent, or harmful purpose;
- Place fraudulent orders, use stolen payment methods, or engage in any form of payment fraud or chargeback abuse;
- Impersonate any person or entity, or falsely represent your identity or affiliation with any person or entity;
- Attempt to gain unauthorized access to any portion of the Site, other user accounts, or any computer systems or networks connected to our Site;
- Use any automated tool, bot, scraper, spider, or other automated means to access, collect data from, or interact with the Site without our prior written consent;
- Introduce any virus, Trojan horse, worm, malware, ransomware, or other harmful or destructive code to the Site or our systems;
- Engage in any activity that could damage, disable, overburden, or impair the Site or interfere with any other party's use of the Site;
- Transmit any unsolicited or unauthorized advertising or promotional material;
- Harass, threaten, intimidate, or abuse any of our employees, contractors, or other users;
- Post or transmit any content that is defamatory, obscene, offensive, hateful, or otherwise objectionable;
- Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any software component of the Site;
- Violate any applicable local, state, federal, or international law or regulation in connection with your use of our services.
Any violation of these prohibitions may result in immediate termination of your access to the Site and services, and may subject you to civil and/or criminal liability under applicable law.
5. Ordering, Pricing, and Payment Terms
5.1 Orders and Pricing
All prices displayed on our Site are in United States Dollars (USD) and are subject to change without prior notice. Prices listed do not include applicable sales tax, delivery fees, or service charges, which will be calculated and displayed prior to your final order confirmation. We reserve the right to correct any pricing errors and will notify you before processing an order affected by such an error.
By submitting an order, you are making an offer to purchase the items selected. We reserve the right to accept or decline any order at our sole discretion. Order confirmation via email or on-screen notification does not constitute our final acceptance of your order. We may cancel or modify any order due to product unavailability, pricing errors, suspected fraud, or violations of these Terms.
5.2 Payment Methods
We accept major credit cards, debit cards, and other payment methods as specified on the Site at the time of checkout. By providing payment information, you represent and warrant that: (i) you are authorized to use the designated payment method; (ii) the payment information you provide is true and accurate; and (iii) charges incurred by you will be honored by your payment provider.
All payment processing is handled through secure third-party payment processors. We do not store your full credit card number on our servers. By placing an order, you authorize us to charge the applicable total to your designated payment method.
5.3 Refunds and Cancellations
Due to the perishable nature of food products, all sales are generally final. Refunds or order credits may be issued at our sole discretion in cases of order errors on our part, significant quality issues, or non-delivery. Refund requests must be submitted within 24 hours of the original order time by contacting us at [email protected]. Cancellations may be accepted if the order has not yet entered the preparation stage; once preparation has begun, cancellations are not guaranteed.
5.4 Taxes
You are responsible for all applicable federal, state, and local sales taxes, use taxes, or other taxes and fees imposed on your order. Applicable taxes will be calculated based on the delivery address provided and displayed at checkout.
6. Intellectual Property Rights
All content and materials available on the Site, including but not limited to text, graphics, logos, button icons, images, audio clips, data compilations, software, and the overall design and layout of the Site ("Content"), are the exclusive property of Dewey's Pizza or its content suppliers and are protected by United States copyright law, trademark law, trade dress, and other intellectual property laws and international treaties.
The Dewey's Pizza name, logo, and all related product and service names, design marks, and slogans are trademarks or service marks of Dewey's Pizza. You may not use any of these marks without our prior written permission. All other trademarks appearing on the Site are the property of their respective owners.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Site and its Content solely for the purpose of using our food ordering services for personal, non-commercial purposes. This license does not include the right to:
- Reproduce, distribute, publicly display, or publicly perform any Content;
- Modify, adapt, translate, or create derivative works based upon the Content;
- Use the Content for any commercial purpose or for any public display, commercial or non-commercial;
- Remove or alter any copyright, trademark, or other proprietary rights notices contained in or on the Content.
Any unauthorized use of the Content terminates this license and may violate copyright laws, trademark laws, and other laws. We reserve all rights not expressly granted in these Terms.
If you submit any feedback, suggestions, reviews, or other communications to us regarding our services ("Feedback"), you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Feedback throughout the world in any media.
7. Disclaimers — As-Is Basis
THE SITE AND ALL SERVICES, CONTENT, AND MATERIALS PROVIDED THROUGH OR IN CONNECTION WITH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DEWEY'S PIZZA EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT;
- WARRANTIES THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS;
- WARRANTIES REGARDING THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF ANY CONTENT OR INFORMATION PROVIDED ON THE SITE;
- WARRANTIES THAT DEFECTS WILL BE CORRECTED OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We do not warrant that the results that may be obtained from the use of the Site will be accurate or reliable. You acknowledge that your use of the Site and our services is at your sole risk.
Nutritional information, ingredient descriptions, and allergen details provided on the Site are offered for general informational purposes only and may not be 100% accurate due to product availability changes, preparation methods, or ingredient substitutions. Customers with specific dietary needs or severe allergies must contact us directly before placing an order.
Estimated delivery times are provided as approximations only and are subject to change based on order volume, traffic, weather conditions, and other factors outside our control. We make no guarantee regarding delivery times and are not liable for delays.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE UNITED STATES LAW, INCLUDING THE FEDERAL TRADE COMMISSION ACT AND ALL APPLICABLE STATE CONSUMER PROTECTION STATUTES, IN NO EVENT SHALL DEWEY'S PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
- LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL;
- COST OF SUBSTITUTE GOODS OR SERVICES;
- DAMAGES ARISING FROM PERSONAL INJURY OR PROPERTY DAMAGE RELATED TO YOUR USE OF OUR SERVICES, TO THE EXTENT PERMITTED BY LAW;
- ANY OTHER DAMAGES OR LOSSES ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SITE OR SERVICES.
These limitations apply whether the alleged liability is based on contract, tort, negligence, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT PAID BY YOU TO DEWEY'S PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for certain types of damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by applicable law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Dewey's Pizza, its officers, directors, shareholders, employees, independent contractors, agents, representatives, successors, and assigns from and against any and all claims, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:
- Your use of or inability to use the Site or services;
- Your violation of any provision of these Terms;
- Your violation of any applicable federal, state, or local law or regulation;
- Your violation of any third-party rights, including without limitation any intellectual property rights, privacy rights, or publicity rights;
- Any false, inaccurate, or misleading information provided by you in connection with your use of our services;
- Any dispute between you and any third party arising in connection with your use of our services;
- Your negligence or willful misconduct.
We reserve the right, at our own expense, to assume exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses. You shall not settle any such claim or matter without our prior written consent.
10. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and disclosure of personal information in connection with your use of the Site and services is governed by our Privacy Policy, which is incorporated into these Terms by reference and available on our Site. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.
To the extent you are a resident of California, your rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA) are described in our Privacy Policy. We do not sell your personal information to third parties.

We provide these links for your convenience only and do not endorse, control, or assume any responsibility for the content, privacy policies, or practices of any third-party websites or services. Your use of third-party payment processors, mapping services, or other integrated services is subject to those parties' respective terms and conditions. We are not responsible for any loss or damage caused by your use of or reliance on any third-party content, goods, or services.
12. Governing Law and Jurisdiction
These Terms of Service and any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Site, or the services provided by Dewey's Pizza shall be governed by and construed in accordance with the laws of the United States and the laws of the applicable state in which Dewey's Pizza operates, without regard to conflict of law principles.
To the extent that any dispute is not resolved through arbitration as set forth in Section 13 below, you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within the United States, in the jurisdiction where Dewey's Pizza's principal place of business is located, and you waive any objection to the exercise of jurisdiction over you by such courts and to venue in such courts.
These Terms are subject to all applicable federal laws of the United States, including the Federal Trade Commission Act (15 U.S.C. § 41 et seq.) as it pertains to unfair or deceptive acts and practices in commerce. Nothing in these Terms shall be deemed to limit any rights you may have under applicable mandatory consumer protection laws.
13. Dispute Resolution and Arbitration
13.1 Informal Resolution
Before initiating any formal legal action, you agree to first attempt to resolve any dispute informally by contacting Dewey's Pizza at [email protected] and providing written notice describing the nature of the dispute and the relief sought. We will attempt to resolve the dispute informally within thirty (30) days of receiving such notice. If the dispute is not resolved within that period, either party may proceed to arbitration as described below.
13.2 Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Except for disputes that qualify for small claims court and except as otherwise provided herein, you and Dewey's Pizza agree that any dispute, claim, or controversy arising out of or relating to these Terms, the breach, termination, enforcement, interpretation, or validity thereof, or your use of the Site or services (collectively, "Disputes") will be resolved solely by binding, individual arbitration and not in a class, representative, or consolidated action or proceeding.
The arbitration will be conducted by a nationally recognized arbitration organization under its then-current rules for consumer disputes. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
You may opt out of this arbitration agreement by sending written notice to us at [email protected] within thirty (30) days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
13.3 Class Action Waiver
YOU AND DEWEY'S PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If a court or arbitrator decides that applicable law precludes enforcement of any of the limitations in this section as to a particular claim or request for relief, then that claim or request for relief shall be decided by a court of competent jurisdiction, and all other claims shall be arbitrated.
14. Term and Termination
These Terms shall remain in full force and effect for as long as you use the Site or services. We may, in our sole discretion and without notice or liability to you, terminate or suspend your access to all or any part of the Site or services at any time, for any reason, including without limitation if we believe that you have violated or acted inconsistently with the letter or spirit of these Terms.
Upon termination of your access to the Site or services:
- Your right to use the Site and services will immediately cease;
- Any pending orders may be cancelled at our discretion, and applicable refunds may be issued;
- All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.
You may also terminate your account at any time by contacting us at [email protected] with a written request for account deletion. We will process your request within a reasonable time, subject to any applicable legal retention obligations.
15. Changes to Terms
We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. If we make material changes to these Terms, we will provide notice by updating the "Last Updated" date at the top of this page and, where appropriate, by sending a notification to the email address associated with your account or by posting a prominent notice on the Site.
Your continued use of the Site or services following the posting of any changes to these Terms constitutes your binding acceptance of those changes. It is your responsibility to review these Terms periodically for changes. If you do not agree to the modified Terms, you must stop using the Site and services and, if applicable, delete your account.

16. Severability
If any provision of these Terms of Service is found by a court of competent jurisdiction or an arbitrator to be invalid, illegal, unenforceable, or contrary to applicable law, such provision shall be deemed modified to the minimum extent necessary to make it enforceable, or if modification is not possible, such provision shall be deemed deleted from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision of these Terms, and the remaining provisions shall continue in full force and effect.
The failure of Dewey's Pizza to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. No waiver by us of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
17. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by us on the Site, constitute the entire agreement between you and Dewey's Pizza concerning your use of the Site and services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter.
No oral statements, promises, representations, or warranties shall be binding upon either party. The section headings used in these Terms are for convenience only and shall not affect the interpretation of these Terms.
18. Force Majeure
Dewey's Pizza shall not be liable for any failure or delay in performance of its obligations under these Terms to the extent such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, storm, earthquake, epidemic, pandemic, war, terrorism, civil unrest, governmental action, labor disputes, power outages, internet or telecommunications failures, or any other cause beyond our reasonable control ("Force Majeure Event").
In the event of a Force Majeure Event, we will make commercially reasonable efforts to notify you and to resume normal operations as soon as practicable. Orders affected by a Force Majeure Event may be cancelled, and applicable refunds may be issued at our discretion.
